SMS / WhatsApp Messaging

We may ask for your mobile number at checkout or on forms on our Site (for example, nickbandy.com/update-info/). Giving us a phone number, even where a form requires one, is not by itself consent to receive text messages; we only text you if you separately agree by checking an unchecked marketing SMS consent box. Consent to texts is optional and is not a condition of purchase or of submitting any form.

If you tick our marketing SMS consent box, Nick Bandy LLC uses your mobile number only to send marketing texts in the Nick Bandy LLC VIP Texts program: a welcome text, then occasional VIP deals and offers on our courses, which may include an offer on a course you started to check out but did not buy. This is our only text program. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. You can also contact us by replying to any email you have received from us.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories of sharing described in this Privacy Policy exclude SMS or WhatsApp originator opt-in data and consent; this information will not be shared with or sold to any third parties. We share mobile numbers only with the service providers that deliver our SMS and WhatsApp messages on our behalf.

Service Providers We Use

We use these service providers to run our business. Each receives only the information it needs to perform its service:

• Stripe processes card payments. We do not store your full card number; Stripe handles it under its own privacy policy.
• WooCommerce and FunnelKit (on our WordPress site) run our checkout, order records, and checkout and order emails.
• Skool hosts our communities and delivers courses; we share your name and email with Skool to invite you after purchase.
• Kit and BerserkerMail send our newsletters and other emails. You can unsubscribe from any email using the link in it.
• Our SMS provider delivers the text messages described in the SMS / WhatsApp Messaging section.
• Meta (Facebook/Instagram), Google and X provide advertising and analytics as described below. A visitor-identification service helps us identify some business visitors, as described below.

Cookies, Tracking Pixels, and Analytics

We and our partners use cookies, pixels, and similar technologies to run the Site, remember your cart, measure traffic, and measure and improve our ads. These include:

• Meta Pixel and Meta Conversions API, which send Meta information such as pages viewed, checkout and purchase events, and hashed contact details (for example, a hashed email address) so we can measure our ads and show ads to people who visited our Site or similar audiences.
• X (Twitter) Pixel, which sends X information such as pages viewed on our Site so we can measure our X ads and show ads to people who visited our Site.
• Google Ads remarketing tag, which lets Google show our ads to people who visited our Site.
• Visitor-identification service, which can match a visit to our Site with publicly available business contact information (for example, a business email address) so we may contact you about our training. To opt out, reply to any email you have received from us and ask us to opt you out, and we will delete that information and stop contacting you.
• Google Analytics 4, which collects usage data such as pages viewed, device and browser type, and approximate location so we can understand how the Site is used.

How to opt out: You can block or delete cookies in your browser settings. You can opt out of Google Analytics with the Google Analytics Opt-out Browser Add-on (tools.google.com/dlpage/gaoptout) and manage Google ad settings at adssettings.google.com. You can control ads from Meta in your Facebook or Instagram ad preferences and ads from X in your X settings under Privacy and safety > Personalization and data. You can also use industry opt-outs at optout.aboutads.info and youradchoices.com. We do not currently respond to browser “Do Not Track” or Global Privacy Control signals. To opt out of the sale or sharing of your personal information for cross-context behavioral advertising, reply to any email from Nick Bandy LLC and ask us to opt you out.

Security of Your Information

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse.

14. SMS and WhatsApp Program Terms

• Program name: Nick Bandy LLC VIP Texts.
• Type of messages: marketing (promotional) text messages only.
• Channels: Nick Bandy LLC may send these messages by SMS text message or WhatsApp, at your number.
• What we send: If you tick the marketing SMS consent box at checkout, on a form on nickbandy.com (such as nickbandy.com/update-info/), or on our thank-you page, Nick Bandy LLC will send you a welcome text, then occasional VIP deals and offers on our courses, which may include an offer on a course you started to check out but did not buy.
• Frequency: Message frequency varies. No more than 2 offers per unfinished checkout. Texts are sent between 12 PM and 8 PM Eastern Time.
• Cost: Message and data rates may apply.
• Opt out: Reply STOP to any message to cancel. You will get one final text confirming you are unsubscribed, and no further texts after that. Reply START to resubscribe. WhatsApp messages are also subject to WhatsApp’s own terms; reply STOP in WhatsApp to opt out there.
• Help: Reply HELP for help, or reply to any email you have received from us.
• Consent: Agreeing to texts is optional and is not a condition of purchase or of submitting any form. Providing a phone number alone is not consent to receive texts. Your consent applies only to Nick Bandy LLC VIP Texts.
• Carriers: Carriers are not liable for delayed or undelivered messages.

15. Purchases, Payments, and Refunds

Payments are processed by Stripe. Refund terms are set offer by offer: the refund terms for each product are those stated on that product’s sales page or checkout page, and those terms control if they differ from anything else on this Site. In short: products labeled with a 30-day money-back guarantee can be refunded by replying to any email from Nick Bandy LLC within 30 days of purchase; products labeled “All sales are final, no refunds” are non-refundable.
